What is the Diesel Emission claim about?
The diesel emission scandal first hit headlines in 2015 when the Volkswagen Group were found to have installed “defeat devices” into their vehicles across several brands, including VW, Audi, Skoda and SEAT. This case, which is still ongoing in the UK, shed light on the practices of car manufacturers and their processes of hiding diesel emission output in order to pass regulatory tests.
Mercedes-Benz’s own dieselgate first began in 2018 when the German Road Vehicle Authority found that they were using illegal software inside several of their models. This illegal software, also known as a defeat device, works by understanding when the vehicle is being tested in the lab and performing differently to hide emissions. Real-world emissions of many of Mercedes vehicles are much higher than advertised, and much higher than legally allowed in the UK.
Many more manufacturers are being investigated, with more news on Vauxhall, Ford, Nissan, Renault, Peugeot, Citroen, Volvo, and BMW coming to light every week.
What does an Emission claim actually relate to?
The claim that will be brought forward by our expert panel of solicitors will relate to various parts of the deception by Mercedes and any other manufacturer. Car giants like Mercedes have potentially suppressed clean emissions technology and concealed the action of installing defeat devices from their customers and lawmakers. If you are a fleet manager, this problem has been exacerbated and compounded by owning numerous “dirty diesel” vehicles at once.
It means that you, as a business customer, have been misled when choosing whether to purchase Mercedes vehicles within your fleet. The potential Fleet Diesel Emission Claim will focus on seeking compensation from Mercedes for deceit, breach of consumer protection laws, breach of contract and breaches of the Competition Act.
Not only has this hurt the environment, it could have hurt your business’s bottom line, with early indications showing that fuel economy is worse off after a fix is applied.
Which models are affected?
Currently, our panel of solicitors are focussing on German car manufacturer Mercedes-Benz. The defeat software in question has been found primarily in Mercedes cars and vans that contain a BlueTec/AdBlue diesel engine. You may be eligible to take legal action against Mercedes-Benz if:
- The car is manufactured by Mercedes-Benz
- It has a BlueTec, diesel engine
- Was made between 2009 – 2019 (E-class from 2010, GLE from 2011)
- Was either bought outright or leased, either new or second hand
Tens of thousands of cars with BlueTec engines haven now been recalled. This includes models such as:
CLS
C-Class
E-Class
G-Class
GLC
GLE
GLK
M-Class
S-Class
SLK
SLC
Sprinter
Vito

THE Most FREQUENTLY ASKED QUESTIONS
-
How much compensation can I receive for an Emissions Claim?
Currently, there is no guidance in the UK in relation to how much Mercedes owners could be owed for a diesel emission claim. It will also depend on how many eligible vehicles you have in your fleet.
In the U.S settlement, for context, current affected vehicle owners and lessees were eligible to receive $3,290 or more.
-
Does the size of my fleet affect how much money I can receive if the claim is successful?
Yes, the amount of affected fleet vehicles you own will affect how much money you are entitled to if the claim is successful. Compensation is usually awarded on a per-vehicle basis. If your fleet is larger, you may receive more compensation.
-
Do I have to own a certain number of fleet vehicles to file a claim?
No, you can claim regardless of the size of your fleet. Indeed, consumers with one personal-use car are launching their own claim.
If you need to claim for just one car or van, we recommend filing a claim through our personal claim form here.
-
Do I have to have my fleet fully paid off to file a claim?
No, you do not have to have your fleet fully paid off to file a diesel emission compensation claim. In fact, many business owners and individuals are filing claims whilst leasing their vehicles and not actually owning them at all.
-
Can I register vehicles which have previously been on our company fleet?
Yes, you can register vehicles which you have previously owned. The diesel emissions may have impacted the price you paid for the vehicle or vehicles at the time. The diesel emissions may have also impacted performance over time.
The timeframe that the vehicle must have been bought, leased, or financed within is 2009-2019. Anything outside of these dates is unfortunately ineligible.
